GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

ARTICLE 1 – Purpose
These General Terms and Conditions of Sale (hereinafter the “Terms”) apply without restriction or reservation to all online sales offered by the company EYELIGHTS via its website: www.eye-lights.com (hereinafter the “Website”).
The Website is an e-commerce platform that enables users (hereinafter the “Buyers”) to purchase a head-up display device and related accessories (hereinafter the “Device”) offered for sale by EYELIGHTS.
These Terms govern the conditions for ordering and delivering the Device, as well as the respective rights and obligations of the parties.
They are accessible at all times via a direct link at the bottom of the Website and may be downloaded or printed.
The applicable version of these Terms is the one available online at the time the Buyer places the order and is also sent to the Buyer along with the order confirmation.
These Terms shall prevail over any other general or specific terms not expressly accepted in writing by EYELIGHTS.
Where applicable, these Terms may be supplemented by specific terms of use applicable to certain services offered on the Website, which shall take precedence in the event of conflict.
ARTICLE 2 – Seller Information and Contact

ARTICLE 3 – Legal Capacity and Acceptance of Terms
3.1 Legal Capacity
Access to the Website is restricted to:
- Any natural person with full legal capacity to enter into a contract;
- Any legal entity acting through a duly authorized representative with authority to bind such entity to the Terms.
3.2 Acceptance of Terms
Acceptance of these Terms is evidenced by the Buyer checking a box in the order form. Such acceptance is deemed full and unconditional. Any conditional acceptance shall be null and void.
Buyers who do not accept these Terms must not place orders via the Website.
ARTICLE 4 – Description of the Device
Prior to placing an order, and in accordance with Article L111-1 of the French Consumer Code, Buyers may review the essential characteristics of the Device on the Website.
The Device is offered for online sale subject to available stock.
Photographs and descriptions of the Device are provided for illustrative purposes only and are as accurate as possible. EYELIGHTS shall only be bound by the information explicitly stated.
ARTICLE 5 – Ordering the Device
5.1 Order Placement
To place an order, the Buyer must select a Device and add it to the shopping cart. The Buyer may review and modify the contents of the cart at any time prior to final order confirmation.
An order is considered received by EYELIGHTS once payment has been validated.
Buyers must provide complete and accurate billing and shipping information. Orders with missing required fields cannot be processed.
The Buyer warrants that all information provided in the order form is accurate, current, truthful, and not misleading.
The Buyer is informed and agrees that such data constitutes proof of identity and is binding upon confirmation.
Once confirmed by the Buyer, an order cannot be modified, suspended, or cancelled without prior written approval by EYELIGHTS. EYELIGHTS reserves the right to revise pricing or delivery timelines for any accepted changes.
5.2 Order Confirmation
Upon payment, the Buyer receives an order confirmation by email summarizing the order and containing links to:
- Download the invoice;
- Download the General Terms and Conditions of Sale;
- Track the delivery status on the EYELIGHTS Website once the order is shipped.
The Buyer is responsible for verifying that the contact details provided are correct and enable proper receipt of the confirmation email. In case of non-receipt, the Buyer must contact EYELIGHTS as indicated in Article 2.
EYELIGHTS recommends that the Buyer save a copy of the order confirmation, which is deemed received once accessible by the Buyer.
ARTICLE 6 – Pricing and Payment Terms
6.1 Prices
Prices of the Device are listed on the Website in euros, inclusive of VAT and applicable taxes.
EYELIGHTS reserves the right to apply promotions or discounts at its sole discretion.
Delivery charges, if applicable, are not included in the listed prices and will vary depending on the delivery country. These charges are displayed before the Buyer confirms the order.
For deliveries outside France, the Buyer is responsible for all customs declarations, taxes, duties, and other applicable fees required to import the Device.
EYELIGHTS shall not be liable for failure to deliver due to the Buyer’s non-compliance with such obligations.
The applicable price is the one in effect at the time the order is submitted.
6.2 Payment Methods
Available payment options are described on the dedicated “Payment Methods” page of the Website.
6.3 Invoicing
Purchase invoices may be sent to the Buyer by any appropriate means, including via email.
6.4 Retention of Title
EYELIGHTS retains full legal ownership of the Device until full payment of the purchase price and any applicable delivery charges is received.
ARTICLE 7 – Delivery
Our full delivery terms and conditions are available on the page titled “Delivery Policy.”
ARTICLE 8 – Legal Warranties
The Buyer benefits from the legal warranties of conformity and hidden defects applicable to goods sold, including defects arising from the product's packaging.
If the Buyer notices that the delivered Device is defective, non-compliant, or damaged, they must notify EYELIGHTS at the contact details provided in Article 2, specifying the nature of the defect or non-conformity, and include appropriate supporting evidence (e.g., photos).
EYELIGHTS will arrange the return process with the carrier of its choice and will inform the Buyer by any appropriate means. EYELIGHTS will bear the cost of return.
The Device must be returned in its original packaging, with all accessories, and accompanied by a copy of the corresponding purchase invoice.
Returns that do not meet the above requirements will not be processed.
Upon verification, EYELIGHTS will propose a replacement of the Device where possible. If replacement is not feasible, EYELIGHTS will issue a full refund, including any delivery charges, by any suitable means and within a maximum of thirty (30) days from the date the Buyer is informed of the unavailability of a replacement.
Buyers acting under the legal warranty of conformity are reminded that:
- They have two (2) years from the delivery date to take action;
- They may choose between repair or replacement, subject to the cost conditions under Article L217-9 of the French Consumer Code;
- They are not required to prove the existence of the defect during the first 24 months following delivery.
This legal warranty of conformity applies independently of any commercial warranty.
The Buyer may also assert the warranty against hidden defects under Article 1641 of the French Civil Code and may, in such cases, choose between rescission of the sale or a reduction in price in accordance with Article 1644 of the Civil Code.
ARTICLE 9 – Buyer Obligations
Buyers are solely responsible for how they use the Device. It is their duty to verify the Device's suitability for their specific needs prior to purchase.
They must use the Device in accordance with the User Guide attached as Annex 2 and any other instructions provided.
Buyers are also responsible for taking all appropriate measures to protect their own data and/or software stored on their electronic devices from any potential risk or damage.
ARTICLE 10 – Liability of EYELIGHTS
10.1 Site Access and Availability
EYELIGHTS performs routine checks to ensure the proper functioning and availability of the Website. It reserves the right to temporarily suspend access for maintenance purposes.
EYELIGHTS shall not be liable for any temporary access issues caused by external factors, force majeure, or disruptions in telecommunications networks.
The Buyer acknowledges their understanding of the Internet and its limitations, including that:
- Data transmission on the Internet is technically unreliable due to the nature of heterogeneous networks;
- Users may be located anywhere in the world;
- Data transmitted over the Internet is not inherently secure and can be intercepted. Any transmission of sensitive information is at the Buyer's own risk.
10.2 Product Suitability
EYELIGHTS makes no warranty that the Device will meet the Buyer’s specific expectations, constraints, or intended use.
10.3 Force Majeure
EYELIGHTS shall not be liable for delays or failure to perform caused by external events or force majeure. This includes, but is not limited to:
- Extreme weather, natural disasters, fire, flooding, lightning;
- Terrorist attacks;
- Telecommunications, transport, or postal service disruptions (including strikes);
- Malware attacks not preventable with existing cybersecurity tools;
- Legal or regulatory mandates imposed by competent authorities that materially impact these Terms.
10.4 Limitation of Liability
In all circumstances, EYELIGHTS’ liability shall be strictly limited to proven, direct damages. It shall not be liable for any damage resulting from improper use of the Device, including use not in accordance with the User Guide or any unauthorized alterations made by the Buyer.
ARTICLE 11 – Intellectual Property
All systems, software, infrastructure, databases, and content of any kind (text, images, visual assets, music, logos, trademarks, etc.) used or displayed by EYELIGHTS on the Website or within the Device are protected by intellectual property rights or database rights.
Any disassembly, decompilation, extraction, reproduction, representation, or reuse of such content—whether in whole or in part—without prior written authorization from EYELIGHTS is strictly prohibited and may lead to legal action.
ARTICLE 12 – Personal Data
EYELIGHTS adheres to a strict data protection policy as described in the Privacy Policy, which the Buyer is expressly invited to review.
ARTICLE 13 – Advertising
EYELIGHTS reserves the right to insert advertisements or promotional content on any page of the Website or in communications with Buyers, in such form and under such conditions as it sees fit.
ARTICLE 14 – Third-Party Websites and Links
EYELIGHTS shall not be held liable for the technical availability of third-party websites or mobile applications (including those of its partners) that the Buyer may access through the Website.
EYELIGHTS assumes no responsibility for the content, advertising, products, or services available on such third-party websites or apps, which remain governed by their own terms and conditions.
EYELIGHTS shall not be involved in any transaction between the Buyer and a third-party provider (including partners) accessed via the Website, and shall not be a party to any dispute regarding product delivery, warranties, representations, or obligations of such third parties.
ARTICLE 15 – Prohibited Conduct
15.1 Strictly Prohibited Actions:
The following are strictly prohibited:
- Any behavior that disrupts, suspends, slows down, or prevents the proper functioning of the Website;
ii. Any intrusion or attempted intrusion into EYELIGHTS’ systems;
iii. Any diversion of Website system resources;
iv. Any actions that place a disproportionate load on Website infrastructure;
v. Any breach of Website security and authentication protocols;
vi. Any activity that infringes on the financial, commercial, or moral rights of EYELIGHTS or its users;
vii. Any use of the Website for purposes other than its intended function;
viii. Any breach of these Terms or applicable laws and regulations.
15.2 Prohibition on Monetization or Resale
It is strictly prohibited to sell, resell, or license all or part of the Website or its contents, or access thereto, for monetary gain or otherwise.
15.3 Enforcement
In the event of any breach of this article, or of applicable laws and regulations, EYELIGHTS reserves the right to take any appropriate legal or technical action and to seek remedies in court.
ARTICLE 16 – Amendments
EYELIGHTS reserves the right to modify these Terms at any time. The version applicable to any given order is the one in force at the time the order is placed by the Buyer.
ARTICLE 17 – Language
In the event that these Terms are translated into one or more foreign languages, the French version shall prevail in case of discrepancies or disputes regarding the meaning of any term or provision.
ARTICLE 18 – Mediation
The Buyer has the right to request, free of charge, mediation for the amicable resolution of any consumer dispute relating to these Terms, in accordance with Articles L611-1 and R152-1 of the French Consumer Code.

If a consumer complaint submitted to EYELIGHTS Customer Service remains unresolved, the Buyer may file a complaint through the ODR platform linked above.
ARTICLE 19 – Governing Law and Jurisdiction
These Terms are governed by French law.
In case of any dispute regarding the validity, interpretation, or performance of these Terms, the Buyer may choose to submit the dispute:
- To the territorially competent court under the French Code of Civil Procedure; or
- To the court of the Buyer’s place of residence at the time of contract formation or occurrence of the alleged harm.
ANNEX 1 – Withdrawal Form (Right of Withdrawal)

ANNEX 2 – Device User Guide
ARTICLE 1 – Definitions
“Bluetooth Kit” refers to the Bluetooth module included with the Device, composed of an audio input (microphone) and audio output (earphones), enabling mobile phone communication via A2DP* and HFP* profiles. It is guaranteed for a maximum range of ten (10) meters under optimal transmission conditions (i.e., no structural interference, no microwave disruption, etc.).
ARTICLE 2 – Prerequisites
The App requires a stable and high-speed Internet connection. EYELIGHTS shall not be held responsible for full or partial malfunctions resulting from insufficient network coverage. Data usage may incur additional costs depending on the user’s mobile plan; EYELIGHTS will not cover any roaming or overage charges.
ARTICLE 3 – Charging, Recharging, and Device Maintenance
IMPORTANT:
- Use only a charger with adequate maximum output power (as specified in the user manual).
- The charger must be connected to a stable, surge-protected power source.
- Connect and disconnect carefully to avoid voltage spikes that could damage the Device.
3.1 Battery Life Disclaimer
Battery life estimates are provided for reference only. Performance depends on usage, settings, and external conditions (e.g., temperature, Bluetooth strength, network quality). EYELIGHTS is not liable for deviations from estimated battery duration.
3.2 Maintenance and Use Instructions
The Device is a Head-Mounted Display (HMD) intended for use on motorcycle helmets for on-road use only. It includes precision optical and miniaturized electronics requiring careful handling.
- 3.2.1 Do not rub the optical prism with abrasive or chemically treated cloths. Use only a clean, dry microfiber cloth.
- 3.2.2 Cables and FPCs must not be pulled, twisted, or bent. Always disconnect connectors by gripping both ends.
- 3.2.3 The Device is not waterproof. Clean only with a lightly dampened cloth (no liquid exposure).
- 3.2.4 Avoid impacts or strain on cables. Position wiring carefully to prevent tension during movement.
- 3.2.5 Do not expose the Device to extreme temperatures, humidity, or high-salinity environments.
WARNING: Never use cleaning products containing acid, acetone, or corrosive agents.
ARTICLE 4 – Installation
4.1 Control Unit Installation
- 4.1.1 Use the adhesive provided to mount the control unit on the outside of the helmet (clean and degrease first).
- 4.1.2 Mount it on the left side of the helmet (clutch side), audio jacks facing backward, charging port downward.
Apply firm pressure and allow 7 days for full adhesion strength. Inspect regularly to avoid detachment.
4.2 Bluetooth Kit Installation
Only use the Bluetooth Kit supplied by EYELIGHTS. Do not use alternative kits. The kit is not waterproof and must not be used in wet conditions.
4.3 Optical Module Installation
- 4.3.1 Launch the “display test” function. A red square will appear in the optical prism.
- 4.3.2 Adjust your view by tilting your head slightly downward as if in a riding position.
- 4.3.3 The red square should be fully visible in the prism without obstructing normal vision.
IMPORTANT: Handle the optical prism by its plastic housing only. Close the helmet visor to avoid wear or damage.
ARTICLE 5 – Device Use
The User must strictly follow the installation and usage instructions. EYELIGHTS disclaims all liability for improper installation or use.
- The Device is designed only for motorcycling on public roads.
- Do not operate the Device while driving unless strictly necessary.
- Excessive screen brightness may affect eyesight—adjust to ambient lighting.
5.1 Pre-ride Checklist
- Ensure the prism is clean;
- Control unit is securely mounted;
- All cables are connected;
- The rubber charging port cover is sealed.
5.2 Weather Conditions
Use only in standard conditions. Avoid using during heavy rain or storms.
5.3 User Profile
The Device is calibrated for one specific helmet and rider. Using it with other users or helmets may impair performance and damage components. EYELIGHTS declines all responsibility in such cases.
5.4 Restrictions
Do not modify or tamper with the Device or App unless authorized by EYELIGHTS (e.g., remote support case).
